Woodbine and Research Strategy Group Research Study Contest (the “Contest”)

Eligibility

Contest is open only to HPIbet.com members who are direct recipients of the survey email invitation from Sponsors and who are legal residents of Canada, excluding Quebec, who have reached the age of majority in their province of residence at time of entry. Contest is not open to employees and those domiciled with employees of the Sponsors or any parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies (“Related Parties”). Sponsors reserves the right to verify the age of potential prize winners and that such persons are not employees (or domiciled with employees) of any Related Parties. Void where prohibited.

How to Enter

No purchase or completion of survey necessary. Contest is void where prohibited or otherwise restricted. Contest begins on October 7, 2022 at 12 a.m. and ends on October 20, 2022, at 11:59 p.m. (the “Contest Period”). Upon completion of the research study survey in full, survey participant will receive one (1) entry into the Contest (each an “entrant”). Limit one (1) entry per survey participant.

To enter the Contest without completing the survey, eligible entrant must email the following information to Research Strategy Group at onlinesurvey@rsginc.net: your full name, email address from which you received the survey invitation, phone number, and date of the email invitation. Mail-in entries will only be accepted by eligible entrants.

Limit of one (1) entry in the Contest per person/email address regardless of the method of entry.

By entering this Contest, entrants agree to be bound by these Contest Rules & Regulations and the decisions of the Sponsors with regards to all aspects of this Contest, including without limitation eligibility and/or disqualification of entrants and/or entries, which are final and binding (without right of appeal).

The odds of winning will depend on the total number of eligible entries received during the Contest Period.

Prizes

There will be five (5) prizes each consisting of a $100 HPIbet account deposit. The prizes are collectively referred to as “Prizes” or individually as the “Prize”. Limit of one (1) prize per person.

All Prize winners must be HPIbet.com members with an account in good standing (for the purpose of this Contest, “good standing” means not cancelled or suspended) and must meet all other terms and conditions of these official rules and regulations in order to be awarded the Prize. Prizes must be accepted as awarded, without substitution, and are not transferable or convertible to cash or allowed to be sold. Prizes do not include anything not explicitly set forth in the Prize descriptions above. The Sponsors reserve the right, in their sole discretion, to substitute the Prizes in whole or in part, for equal or greater value, in the event that all or any of the components of the Prizes are unavailable. By accepting the Prize, the winner consents to the use and disclosure of the his/her name, likeness, address (city/province), voice, statements, submission(s) and any photographs taken of winner, in whole or in part, or as modified at the Sponsors’ sole discretion, in connection with the advertising, exhibiting, marketing, and promotion of the business of the Sponsors in any manner, in all media throughout the world without further compensation and without further notice, except where prohibited by law. The winner may be required to sign a release document to that effect.

Prize Drawing

Sponsors will select five (5) potential winners from amongst all eligible entries received during the Contest Period in a random drawing at approximately 10a.m. on October 24, 2022. The Sponsors will attempt to contact the potential winners by sending a message via email to the email address the survey invitation was sent to. If the selected entrants cannot be reached after three (3) attempts to contact, Sponsors shall have the right to choose an alternate entrant from the remaining eligible entries. This process shall continue until all Prizes have been awarded. To receive their Prize, potential winners must successfully confirm receipt of the email notification by completing a mathematical skill testing question, to be administered via email. Winners may be required to sign a declaration confirming understanding of, compliance with, and acceptance of the Contest rules and acceptance of the Prize as awarded and a standard release of all liability satisfactory to the Sponsors before being declared a Prize winner.

General Rules

The Sponsors shall not be liable for lost, late, incomplete, misdirected, and not received, stolen, mutilated, or illegible surveys or entries. By entering this Contest, entrants accept and agree to be bound by these rules and the decisions of the Sponsors, which are final, binding and conclusive on all matters relating to this Contest. All entries become the property of the Sponsors, none will be returned and no correspondence will be entered into except with selected entrants who will be notified by email message. The Sponsors reserve the right to disqualify all entrants who fail to follow these official rules and regulations or who make any misrepresentation relating to the Contest, drawing and redemption of the Prizes. This Contest is subject to all applicable Federal, Provincial and Municipal legislation. Decisions of the Sponsors are final with respect to all aspects of this Contest. Sponsors and their affiliated companies are not responsible for any failure of any electronic equipment, computer transmissions and/or network connections. Sponsors and their affiliated companies are not responsible for any inaccuracies in information which may be used in the Contest, or for any technical or human error which may occur in the processing of entries, including data entered by entrants. Sponsors and their affiliated companies reserve the right to discontinue the Contest at any time, in which event, only entries received prior to that date will be eligible.

The Sponsors shall not be responsible for any website or wireless network failure during the survey or Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email, online, Internet or mobile entry to be received by the Sponsors. In addition, the Sponsors shall not be responsible if due to technical problems, traffic congestion on the Internet or any wireless network, or any combination thereof for any damage including any injury or damage to an entrant’s or any other person’s computer, mobile phone or property related to or resulting from participating in the Promotion. The Sponsors reserve the right, at their sole discretion to modify, cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

In the event of a dispute, entries will be deemed to have been submitted by the Authorized account holder of the email account from which the entry is made. “Authorized account holder” is defined as person to whom an email address is assigned by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an entrant is disputed, the Authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the Authorized account holder of the email account associated with the selected entry name change. The sole determinant of the time for the purposes of a valid email entry in this Contest will be the Contest server machine(s).

Privacy

Any personal information gathered will be handled in strict accordance with Sponsors’ privacy policies, available at https://woodbine.com/privacy-policy/ and https://rsginc.net/privacy-policy/ respectively, and all applicable privacy legislation. The information provided in connection with the Contest will not be provided to third parties, except as necessary for the administration of the Contest or as required by law or legal process.

No Liability

Neither Sponsors, nor their respective parents, subsidiary or affiliated entities, and each party’s respective officers, directors, employees, agencies or representatives, (collectively the “Released Parties”) shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prizes awarded in this Contest or the events forming part of this Contest. By participating or accepting a Prize, all entrants release and hold harmless the Released Parties from any and all liability or any injuries, loss or damage of any kind arising from or relating to participation in this Contest or acceptance, use, misuse or nonuse of the Prize or parts thereof, and from liability to any other persons relating to or resulting from entering this Contest.

Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest or the Contest Rules or the rights and obligations as between the entrants and Sponsors in connection with the Contest shall be (a) resolved individually, without resort to any form of class action; and (b) governed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. All parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.
